These Terms of Service (“Terms”) govern your access to and use of happycluck.com and your purchase of products from Happy Cluck Organics (“Happy Cluck,” “we,” “us”). By accessing the Site or placing an order, you agree to these Terms. Please read them carefully.

1. Eligibility & Accounts

You must be at least the age of majority in your jurisdiction to purchase from us. You are responsible for the accuracy of the information you provide and for maintaining the confidentiality of any account credentials.

2. Products & Orders

We describe our products as accurately as possible, but we do not warrant that descriptions, images, or other content are error-free. All orders are offers to purchase and are subject to acceptance and availability. We reserve the right to refuse or cancel any order, limit quantities, or correct pricing or other errors, including after an order has been submitted.

3. Pricing & Payment

Prices are listed in U.S. dollars and are subject to change without notice. You authorize us and our payment processors to charge your selected payment method for the total amount of your order, including taxes and shipping where applicable.

4. Subscriptions (Subscribe & Save)

If you enroll in a subscription, you authorize recurring charges to your payment method at the interval you select until you cancel. You can skip, swap, change cadence, pause, or cancel at any time from your account page, or by emailing support@happycluck.com - our team will take care of it promptly. Cancellations apply to future shipments; orders already processed may not be cancellable.

5. Shipping, Returns & Guarantee

Shipping timelines, costs, and our return process are described on our Shipping & Returns page, which is incorporated into these Terms. Every first order is backed by our 60-Day Happy Flock Guarantee: feed the whole pouch, and if your flock is not visibly happier within 60 days of delivery, contact us and we will refund every penny - empty pouch and all (first order per product, up to 2 units, direct purchases).

6. Wellness Disclaimer

Happy Cluck products are whole-food herbal supplements and care products intended to support general flock wellness. These statements have not been evaluated by the U.S. Food and Drug Administration, and our products are not intended to diagnose, treat, cure, or prevent any disease. They are not a substitute for veterinary care. Always consult a licensed veterinarian for sick, injured, or distressed birds. Individual results may vary.

7. Acceptable Use

You agree not to misuse the Site, interfere with its operation, attempt unauthorized access, or use it for any unlawful purpose.

8. Intellectual Property

All content on the Site - including text, graphics, logos, photographs, and the Happy Cluck name and branding - is owned by or licensed to us and protected by intellectual-property laws. You may not use it without our prior written permission.

9. Disclaimers & Limitation of Liability

The Site and products are provided “as is” and “as available” without warranties of any kind, express or implied, except as required by law. To the fullest extent permitted by law, Happy Cluck and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, and our total liability for any claim arising out of or relating to the Site or products will not exceed the amount you paid for the product giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless Happy Cluck from claims arising out of your violation of these Terms or misuse of the Site or products.

11. Governing Law & Disputes

These Terms are governed by the laws of the United States and the State in which Happy Cluck is organized, without regard to conflict-of-laws principles. Any dispute will be resolved in the courts located in that State, unless otherwise required by applicable law.

12. Changes

We may update these Terms at any time. The “last updated” date reflects the latest version, and your continued use of the Site constitutes acceptance.
